Starting a Nonprofit, Where In The IRC (Internal Revenue Code) Does My Organization Fall?

A nonprofit organization founded and operated for charitable purposes may be exempt under Section 501(c)(3). This is what most people mean when talking about a nonprofit. It has federal income tax exemption, contributions to it are tax deductible to the donor and it is potentially state sales & property tax exempt. Incentives like these exemptions are provided by the government when an organization’s purpose is religious, educational, charitable, scientific, literary, testing for public safety, to foster national or international sports competition, or prevention of cruelty to children or animals.

A nonprofit founded and operated for social welfare purposes may be exempt under Section 501(c)(4). These organizations lean toward advocacy work, political actions, lobbying, environmental purposes, homeowners’ associations, and various community associations.

Some less common types of nonprofit organizations can include 501(c)(6) (Business Leagues) and 501(c)(7) (recreation, pleasure, social activities, and other similar nonprofit endeavors) organizations.

What Forms Do I Need To Gain Tax Exempt Status For My Not For Profit Organization?

For 501(c)(3) Organizations, the form you need to fill out to receive tax exempt status is determined by the organization’s projected annual gross receipts and assets.

Form 1023 EZ

  • Past, present, and planned activities
  • Compensation of directors, officers, trustees, and certain highly paid employees and contractors (“Close Personnel”)
  • Compensation of Close Personnel from related organizations
  • Sales and/or contracts between the organization and any Close Personnel (including any organizations they have certain affiliations with)
  • Family and business relationships among directors, officers, and trustees
  • Goods, services, and/or funds (grants) provided to individuals or organizations
  • Fundraising programs

This form requires more in depth clarification as to the following issues:
